1. Acceptance of Terms

By accessing or using AfroPendo ("the Platform", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and AfroPendo. Your use of the Platform is also subject to our Privacy Policy, which is incorporated herein by reference.

2. Eligibility Requirements

You may only use AfroPendo if:

• You are at least 18 years of age
• You are legally capable of entering into a binding contract
• You are not located in a country subject to embargo or sanctions
• You have not been previously suspended or removed from our Platform
• You agree to provide accurate, current, and complete information
• You are not a registered sex offender
• You have not been convicted of violent crimes or fraud

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, truthful, and complete information
• Maintain the security of your login credentials
• Notify us immediately of unauthorized access
• Not share your account with anyone else
• Be solely responsible for all activity under your account
• Not create multiple accounts without authorization
• Not use bots or automated systems to create accounts

4. User Conduct & Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

Violation of these rules may result in immediate account suspension or termination, and in serious cases, referral to law enforcement authorities.

5. Content Policy

You retain ownership of any content you post on AfroPendo. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content for platform operations.

Prohibited content includes:

• Nudity, sexually explicit material, or pornography
• Hate speech, discrimination, or harassment
• Violent, graphic, or disturbing content
• Copyrighted material without permission
• False, misleading, or deceptive information
• Personal contact information (until matching)

6. Subscriptions & Payments

AfroPendo offers both free and paid subscription plans. For paid plans:

• Subscription fees are billed in advance on a recurring basis (weekly, monthly, or yearly)
• Prices may vary by region and currency
• We accept M-Pesa, Airtel Money, Credit/Debit cards, and Bank transfers
• All payments are processed through secure, PCI-compliant third-party processors
• We do not store full credit card details on our servers
• Taxes may apply based on your location

7. Cancellation & Refunds

Cancellation Policy: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Refund Policy: We offer a 7-day money-back guarantee for new subscribers. After 7 days, subscription fees are non-refundable. Refunds are processed within 5-10 business days.

Refund exceptions: Partial months, unused features, or account termination due to Terms violations are not eligible for refunds.

8. Verification & Identity

We offer optional and mandatory verification features to build trust and safety:

• Email verification: Required for all accounts
• Phone verification: Required for all accounts (SMS code)
• ID verification: Optional but recommended (government ID, passport)
• Verification badges: Displayed on profiles to build trust

We use third-party services to verify identity documents. Your ID information is encrypted and deleted after verification in accordance with our Privacy Policy.

9. Safety Features

We provide safety tools, but your personal safety is ultimately your responsibility:

• Reporting: Report suspicious users or behavior
• Blocking: Block users who make you uncomfortable
• Safe Date Check-in: Share location with emergency contacts
• Emergency contacts: Add trusted contacts for emergencies
• Video calls: Verify identity before meeting in person

10. Intellectual Property

All content on AfroPendo (excluding user-generated content) including logos, designs, text, graphics, software, and code is owned by AfroPendo or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Platform without written permission.

11. Privacy & Data Protection

Your privacy is critically important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using AfroPendo, you consent to our data practices as described.

We comply with GDPR, Kenyan Data Protection Act 2019, POPIA, NDPR, and other applicable privacy laws.

12. Third-Party Links

Our Platform may contain links to third-party websites. We are not responsible for their content, privacy practices, or terms. Access them at your own risk.

13. Disclaimers

AfroPendo IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• We do not guarantee you will find a match or relationship
• We are not responsible for user conduct or compatibility
• We do not warrant uninterrupted or error-free service
• We are not liable for losses from unauthorized account access
• We do not conduct criminal background checks (use your judgment)

14. Limitation of Liability

To the maximum extent permitted by law, AfroPendo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.

Our total liability shall not exceed the amount you paid us in the past 12 months or $100, whichever is greater.

15. Indemnification

You agree to indemnify and hold AfroPendo harmless from any claims, damages, losses, or expenses arising from your violation of these Terms, your use of the Platform, or your interaction with other users.

16. Termination

We may terminate or suspend your account immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Harassment or abuse of other users
• Extended account inactivity (2+ years)
• At our sole discretion

You may delete your account at any time through Settings. Upon termination, your license to use the Platform ends immediately.

17. Governing Law

These Terms are governed by the laws of Kenya, without regard to conflict of law principles. For users in other jurisdictions, local consumer protection laws may apply.

18. Dispute Resolution

Before filing a legal claim, you agree to first contact us to resolve the dispute informally. If unresolved, disputes shall be resolved through binding arbitration in Nairobi, Kenya, under Kenyan arbitration rules, rather than in court.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

19. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Continued use of the Platform after changes constitutes acceptance. If you don't agree, you may delete your account.
